New instructions on the procedure for the author's supervision of construction

On 18.10.2020, Resolution of the Ministry of Architecture and Construction of the Republic of Belarus “On Approval of the Instruction on the Procedure for Author's Supervision of Construction” (Instruction) No. 39 of 04.08.2020 came into force.

The Instruction replaced Technical Code of Common Practice 45-1. 03-207-2010 “Author's Supervision in Construction. The Procedure for Conducting”.

The instruction defines the procedure for the author's supervision of construction during installation, reconstruction, repair, restoration, as well as during technical modernization, improvement, demolition, and conservation of an unfinished object.

A working group, if necessary, includes representatives of the survey and specialized organizations, as well as specialists with experience in the protection of historical and cultural heritage for objects included in the list of material objects that are assigned the status and category of historical and cultural values of the Republic of Belarus, in accordance with Annex 1 to Resolution of the Council of Ministers of the Republic of Belarus “On the Status of Historical and Cultural Values” No. 578 of 14.05.2007.

A customer is obliged, until the completion of construction, to transmit for storage to a general contractor (contractor) the schedule of the representatives of the author's supervision, the list of critical structures and main types of works subject to acceptance involving representatives of the author's supervision and order of general contractor concerning the determination of the composition and appointment of the head of the working group.

A contract for the author's supervision shall provide for the period during which a general designer draws up the journal of the author's supervision and transmits it to a customer.

The Instruction approves the forms of sheets of the journal of author’s supervision, which differ slightly from the forms given earlier in the Technical Сode of Common Practice 45-1. 03-207-2010.

It is not allowed to withdraw the journal of the author's supervision from a construction site and store it outside the site.

After acceptance of the facility, the general contractor (contractor) transfers filled in and signed by the general designer and the customer journal of author’s supervision to an operating organization for storage.

Representatives of the author's supervision have the right to keep photographic evidence of sheets of the journal of the author's supervision and ensure their distribution to concerned parties.

The Instruction also describes in detail the functions of various representatives of the author's supervision, for instance, a specialist in sanitary equipment and a specialist in security and fire alarm systems.
