Expansion of bans for foreign investors from “unfriendly” states and not only
A ban has been established on the reorganization of Belarusian commercial organizations included in the List, and the withdrawal of shareholders that are persons from a foreign state committing unfriendly actions against Belarusian legal entities and (or) individuals from these organizations.
The Edict of the President No. 93 dated 14.03.2022 “On Additional Measures to Ensure the Stable Functioning of the Economy” have been amended accordingly.
The new bans affect not only foreign shareholders from “unfriendly” states, but also Belarusian organizations included in the List since they are prohibited from reorganizing. While reorganization is often used by Belarusian companies as an effective tool to achieve their business goals. The ban applies to all forms of reorganization of Belarusian organizations, including merger and transformation, not entailing the replacement of foreign shareholders.
