Important and expected clarifications on building materials prices from the Ministry of Antimonopoly Regulation and Trade and the Ministry of Architecture and Construction
The main approaches to regulation:
- The building materials prices are not always regulated.
- The main regulatory acts:
- the Government Resolution No. 447 of 06.07.2022 “On Price Regulation” (hereinafter referred to as Resolution No. 447),
- the Government Resolution No. 713 of 19.10.2022 “On the price regulation system” (hereinafter referred to as Resolution No. 713).
- Prior to the clarification the question remained open - whether the sale of consumer goods to the construction falls under the Resolution № 713, which does not apply to cases of “sales of goods used in the production process” (item 23).
- The regulation depends on a) the purpose of the sale and b) the status of the customer.
- Sales of “building” consumer goods (Annex 1 to Resolution No. 713) a) to business entities b) for use in the production of construction work (including maintenance and landscaping) and (or) materials for construction and goods from the Resolution № 447- only the “building” Resolution № 447 applies.
- Sales of “building” consumer goods to citizens not for entrepreneurship - the Resolution No. 713 applies.
- The building materials prices are not regulated if а) the building materials are from the lists of the Resolution № 447 and the Resolution № 713 b) sold to business entities с) rom stores, pavilions, kiosks d) for maintenance and landscaping of their own territories.
