One coefficient to rule them all: salary and liability

On April 18, 2026, the Law "On Amending Codes Pertaining to Administrative Liability" was published, introducing over a hundred changes to the Code of Administrative Offenses. In particular, liability was established for violating cybersecurity rules, token transaction procedures, requirements for mobile network coverage and service quality, and procedures for purchasing corporate and special passenger vehicles. The liability for labor law violations was also amended.

Let us focus on the changes to the "labor-related" Article 10.12:

  1. The previous general category of offenses has been divided into distinct specific offenses. Violations of working hours and rest periods, violations of hiring procedures, and other labor law violations are now classified separately.
  2. Liability has been introduced for paying a manager's salary in excess of the ratio to the average salary, as well as for effectively allowing an employee to work without a written employment contract. This ratio cannot exceed 8 (Resolution of the Council of Ministers of the Republic of Belarus No. 597).
  3. Fines:
  • for paying a salary exceeding the permissible ratio, the penalty is 15 to 30 base values for responsible individuals, and 100 to 200% of the excess amount for the organization.
  • for allowing an employee to work without a written employment contract, fines range from 20 to 50 base values for individuals, 40 to 100 base values for individual entrepreneurs (IEs), and 100 to 200 base values for organizations. In the event of a repeated violation within a year, the fines increase to 40–100, 80–150, and 150–300 base values, respectively (one base value is 45 BYN).

The new edition of Article 10.12 comes into force on June 18, 2026.
